The Board should remember that it does not have to be held "hostage"
to statements made by an applicant to the effect that if they do not get
their variance then the cesspools will be used indefinitely and pose a
greater environmental risk. At any time, should the Board, in their opinion,
find that the existing cesspools pose a substantial enough risk to the
public health or the environment, they can order the immediate upgrade
to maximum feasible compliance, without increased flows allowed ( Section
15.303).
